Pre and Post Nuptial Agreements


Tina can do a lot in the case of an unmarried couple A pre-nuptial agreement is an arrangement made before a marriage or civil partnership defining who owns what before the marriage and how assets will be divided in the case of a divorce or separation. A post-nuptial agreement is a formal agreement of the same nature, entered into after a marriage or civil partnership.

Whilst these agreements are not legally binding in England and Wales, a court is likely to give weight to them as long as both parties have freely entered into the agreement, shown a full understanding of the implications at the time of signing and that, in the circumstances, the agreement is still fair and reasonable.
