Pre and Post Nuptial Agreements

Tina can do a lot in the case of an unmarried couple A pre-nuptial agreement is an arrangement made before a marriage or civil partnership defining who owns what before the marriage and how assets will be divided in the case of a divorce or separation. A post-nuptial agreement is a formal agreement of the same nature, entered into after a marriage or civil partnership.

Whilst these agreements are not legally binding in England and Wales, a court is likely to give weight to them as long as both parties have freely entered into the agreement, shown a full understanding of the implications at the time of signing and that, in the circumstances, the agreement is still fair and reasonable.

O'Malley Solicitors is experienced in drafting such agreements ensuring fair and realistic division of assets which a court is more likely to uphold as it shows both parties' appreciation and understanding of the agreement.
