Domestic Injunctions

Tina also deals with Domestic Injunctions Domestic abuse, also known as domestic violence, can take a physical, emotional or mental form, and is more common than you may think. When you separate from your partner, the risk of domestic abuse increases and you may find that you need to protect yourself and your children urgently.

O'Malley Solicitors recognise how distressing domestic abuse can be and aim to deal with the issues as quickly and sensitively and possible. There are two types of injunctions; a non-molestation order and an occupation order. A non-molestation order is an urgent application to the court for protection from harassment, violence or even threats of violence. Domestic abuse need not be purely physical; an injunction can also offer protection from emotional and mental abuse. An occupation order can prevent further abuse by ordering the perpetrator to vacate the home immediately, as well as ordering that person to stop their abusive behaviour. Often an application for both orders is made at the same time and both may have a power of arrest attached, enabling the police to arrest the perpetrator immediately in the event of a breach. This is a criminal offence and may be punishable by a caution, fine or imprisonment.

O'Malley Solicitors understand the urgency with which the injunctions must be made and have helped and supported many clients through this distressing issue. If you or anyone you know is suffering from any form of domestic abuse contact us on 01954 202075 for help.
